The European Court for Human Rights issued decisions this week in cases brought by two Arab “mujahidin”–foreign Muslims who fought with the Bosniak army during the civil war–against the government of BiH. In the case of Abu Hamza al-Suri, a prominent Syrian-born ex-fighter, the court found that deporting him to Syria would put al-Suri at significant risk of torture or harm, and would thus be unlawful. The court also examined BiH detention policies for mujahidin.
