Stasa Kosarac, leader of the SNSD caucus in the BiH House of Representatives, said yesterday that the High Representative has no right to criticize the planned referendum on the RS state holiday. Not only is it within the entity’s right to hold a referendum, according to Kosarac, OHR itself has in the past violated rulings of the BiH Constitutional Court, which it now says are “final and binding.”
“In March 2007, the High Representative brutally annulled the Constitutional Court’s decision that ruled the OHR had violated the human rights of the dismissed Srpska officials. The High Representative at the time, Christian Schwarz-Schilling, forbade the State institutions to execute the Constitutional Court’s decision, which was not to the liking of the international community and that is why Valentin Inzko and other OHR officials today sound tragicomic when they say that the decisions of the BiH Constitutional Court are final and binding,” Kosarac told Srna.
